The website www.iterita.com and its domain are the property of Itérita Consulting SL, with CIF B83621219, with registered office at MÁLAGA (CP 29590), Avenida Juan López Peñalver 8, registered in the Companies Register of Málaga, in volume 5941, book 4848, folio 96, section 8, page MA155785, and with telephone number 91 559 19 19.
Itérita Consulting SL, hereinafter referred to as ITÉRITA, is a detective company incorporated in accordance with Article 105 of Royal Decree 2364 of 9 December 1994, approving the Private Security Regulations.
I. General conditions for accessing and browsing the website
- It will be understood that access or the mere use of iterita.com by the User implies the User’s adherence to the general conditions that ITÉRITA has published at each moment in which he/she accesses iterita.com, and does not generate the establishment of any type of contract or commercial relationship between ITÉRITA and the User.
- The purpose of these general conditions is to regulate access, browsing and use of iterita.com, but independently of these, ITÉRITA may establish particular conditions that regulate the use and/or contracting of specific services offered to Users through iterita.com.
- The present conditions and those of the different products and services may be modified by ITÉRITA when it deems appropriate and will be valid from their publication on the web, notifying it when appropriate.
- ITÉRITA offers through its web site products and services to the Users, which will be subject to these conditions and to those that are applied for each one of the products and services, which must be known and accepted, which in no case will exempt from the fulfilment of the present conditions, except for specific and express manifestation to the contrary.
The contents offered through the web are the property of ITÉRITA or it has authorisation for their distribution and are up to date, with ITÉRITA making every effort to purify errors.
ITÉRITA is not responsible for errors in the contents supplied by third parties that may appear on its WEB, reserving the right to modify them at any time. - The contents included in iterita.com are only provided to consumers or end users. Any unauthorised commercial use of the same, or their resale, is prohibited, except with the prior written authorisation of ITÉRITA.
- Given that for the use and/or contracting of the services of iterita.com the use of a password is necessary, ITÉRITA will provide the User with the same, and the User undertakes to use it diligently and to keep the password secret in order to access these services. Consequently, the Users are responsible for the adequate custody and confidentiality of any identifiers and/or passwords supplied by ITÉRITA, and undertake not to cede their use to third parties, whether temporary or permanent, nor to allow access to them to third parties. The User will be responsible for the illicit use of the services by any illegitimate third party who uses a password for this purpose due to non-diligent use or loss of the same by the User.
By virtue of the above, it is the obligation of the User to immediately notify the managers of iterita.com of any fact that allows the improper use of the identifiers and/or passwords, such as theft, loss, or unauthorised access to them, in order to proceed to their immediate cancellation. As long as such events are not communicated, ITÉRITA will be exempt from any responsibility that may derive from the improper use of the identifiers or passwords by unauthorised third parties. - Access, browsing and use of iterita.com is the responsibility of the User, for which he/she undertakes to diligently and faithfully observe any additional instructions given by ITÉRITA or by personnel with its authorisation, relating to the use of iterita.com and its contents.
Therefore, the User undertakes to use the contents in a diligent, correct and licit manner and, in particular, undertakes to abstain from:- use the contents for purposes or with effects contrary to the law, morality and generally accepted good customs or public order;
- reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the contents, unless authorised by the owner of the corresponding rights or it is legally permitted;
- use the contents and, in particular, information of any kind obtained through the website or services to send advertising, communications for the purposes of direct sales or for any other commercial purpose, unsolicited messages addressed to a number of people regardless of their purpose, as well as to refrain from commercialising or disclosing this information in any way.
II. Access to the services provided by ITÉRITA
As has been indicated, users, by means of a personal and unique password, which will be provided to them after agreement on the form of payment for the services and/or the signing of the pertinent contract, if applicable, can make requests for services to ITÉRITA twenty-four hours a day. The ITÉRITA detectives will carry out the work commissioned and will deposit the result materialised in the pertinent reports at the exclusive disposal of their clients, which by means of their personal password can be accessed for reading or printing during the thirty days immediately following that in which they are deposited at their disposal. The results of the investigations shall be strictly confidential, and clients may not disclose their contents to third parties, except for their use in legal proceedings, where applicable, and they shall be responsible for the consequences of leaking or disclosing their contents, in all cases, especially those relating to natural persons.
Users can also, by the same procedure, access ITÉRITA’s database of business reports, relating exclusively to legal persons. Reports on business activities carried out by professionals and/or self-employed persons must be requested expressly and individually and will be carried out by means of the relevant actions and/or investigations, which will also be of a reserved and confidential nature.
The results of research reports and commercial reports may be used by clients for any legally admissible purpose of their interest; evaluation of creditworthiness and classification of clients, legal proceedings, etc., considering that:
- Under no circumstances should they be considered exhaustive or used as the sole decision-making instrument, as their content, although it may be very extensive and as a result of the recommendations proposed by ITÉRITA and accepted by the Client, in any case is limited to knowledge of the facts that can be legally investigated and considered of interest in each case, and cannot be extended to those that the law prohibits because they affect the privacy of individuals, crimes whose investigation is reserved for the judicial bodies and State security forces and bodies or other very personal aspects.
- Similarly, and all the more so because of the lesser degree of investigation of their content, trade reports should be assessed in the context of the best possible tools for making the most accurate decisions on the purposes for which they have been obtained, and should not be used as the sole decision-making or evidentiary elements, given that they are obtained through the collection of data that may sometimes contain errors in their sources.
III. Limitation of Liability
ITÉRITA will not be held responsible for the bad use that the Users may make of its web, nor for viruses or other elements that may exist and cause damage to the computer systems, electronic documents or files of the Users of its web or of the web of third parties.
Likewise, ITÉRITA is neither responsible nor liable for the content of the web sites to which it links from its web page, nor for the products and services offered on said web sites.
IV. Intellectual and Industrial Property
On this web site, the texts, sounds, brands, software and other contents included are the property of ITÉRITA and are protected by current legislation on intellectual property. Access to the Web does not imply the acquisition of any right over them by the Users, and their modification, copying, commercialisation, reproduction, downloading, transmission or distribution is expressly prohibited.
The User will be able to use the contents that can be downloaded to their terminal only for private use. The brands or distinctive signs that appear on the web are owned by ITÉRITA or legally ceded by third parties, and their use for any purpose is expressly prohibited.
V. Navigation and Safety
Browsing the pages of our website can be done completely anonymously and our web servers only keep a series of public and freely accessible data for strictly statistical purposes. These data are the domain name or IP address of the Internet access provider with which the User accesses our website, the date and time of access to our website and the Internet address from which the hyperlink to our website originated.
This website does not use cookies. Although the Spanish Data Protection Agency considers IPs to be personal data, the owner of this website cannot obtain by itself, nor does it intend to do so unless it would cause any damage, any information about the owner to whom the internet connection corresponds, and this data is stored and used solely for the control and statistics of the website and in compliance, where appropriate, with the provisions of the LSSI.
Likewise, we inform you that ITÉRITA will make the maximum efforts to guarantee navigation through its web, and warns that it has been designed to support the Microsoft Internet Explorer 6.X navigator and is not responsible for the damages that the Users may suffer due to the use of versions of navigators different to those for which this web has been designed.
VI. Data Protection and Electronic Communications
The User is unequivocally and precisely informed, and expressly authorises ITÉRITA to collect and automatically process in a File for which it is Responsible, the data obtained as a consequence of the relationship established between the User and ITÉRITA for the sole purpose of maintenance, development or control of the commercial relationship between the Holder and ITÉRITA, as well as to send information and publicity about its products and services and other companies related to the information, catering, telecommunications, financial, insurance and energy sectors, development or control of the commercial relationship between the Holder and ITÉRITA, as well as sending information and publicity of its products and services and of other companies related to the information, catering, telecommunications, financial, insurance, energy, leisure, training, food, automobile, NGO’s, textile, large consumption, water sectors. Likewise, in compliance with Law 34/2000, of 11 July, of Services of the Information Society and Electronic Commerce, ITÉRITA will request in any form in which personal data are requested the express consent of the User for the sending of commercial communications. All the data provided are obligatory, unless otherwise stated, in order to be able to deliver the Products and Services requested. The client who does not wish to receive information on the Products and services of ITÉRITA and/or of the sectors previously mentioned, will be able to refuse consent by sending an e-mail with the data provided to the following address: [email protected]. VII. Legislation and Jurisdiction
The performance, execution and interpretation of this contract shall be subject to Spanish legislation; Civil Code, Commercial Code, Private Security Law and its Regulations, and other applicable substantive provisions, and in the event of any dispute, this agreement shall be subject, with express waiver of any other jurisdiction that may correspond to the parties, to the jurisdiction of the Courts and Tribunals of Madrid.
